2010 AGRICULTURAL EXEMPTION DENIALS ISSUED BY LEE COUNTY FLORIDA PROPERTY APPRAISER ON JUNE 25, 2010

The Lee County Property Appraiser issued 230 tax year 2010 AGRICULTURAL EXEMPTION DENIALS on June 25, 2010 (see the excel list below to see if you have been denied).  This # is less than half the # of denials over the last several years, but these denial remain a huge tax impact on the affected owners. Owners of denied parcels now have just 30 days from the denial date to file a VALUE ADJUSTMENT BOARD petition to contest the determination and to attempt to obtain the AG exemption. Petitions are filed online (leeclerk.org) or by mail or in person, but in either case must be RECEIVED by the deadline date, not just sent or postmarked by that date. Owners can safely use July 26, 2010 as the deadline date for petitioning. The failure to timely petition operates as a waiver of the right to administratively appeal and leaves such untimely owner with the right to file a much more expensive and time consuming Circuit Court lawsuit as his sole remaining remedy.

The Hagen Law Firm has 17 years of agricultural exemption law experience, both as the in-house attorney for the Lee Co.
